    Welcome to the Trihound Site  of Trihound, LLC (“Trihound” or “we”) at www.trihound.com (the “Trihound Site”). 

    1. Agreement. These terms of use (“TOU”) constitute a legally binding agreement between you and Trihound that apply to your use of the Trihound Site and any items that you buy here.   We may modify these TOU without notice to you, so you are advised to check the TOU periodically.

    2. Shipping; Title; Risk of Loss.  We will ship your item through the U.S. Postal Service. Both title and the risk of loss to/for any item that you buy pass to you upon our delivery of that item to the shipper.

    3. Returns and Exchanges.  If for some reason, you do not love your Trihound purchase, you may return or exchange it within 14 (fourteen) days of receipt if the item is unused and in its original packaging. To return or exchange an item, fill out the return/exchange form enclosed with your item, enclose it in the package, and send the package back to us.  Unfortunately, we cannot refund your shipping costs.

    4. Ownership of Intellectual Property. All text, images, and graphics on the Trihound Site belong exclusively to Trihound. TRIHOUND™ and TRI HOUND™ are trademarks of Trihound, LLC and the subjects of pending applications with the U.S. Trademark Office. You may not use these trademarks in any way without our consent, including, without limitation, in any way that is likely to cause confusion or that disparages or discredits us. Trihound owns all other rights in and to all items that we sell, including, without limitation, all copyright and trade-dress rights.

    5. Privacy.  You can find our privacy policy, which governs your visit to the Trihound Site and our use of your personal information in connection with shipping and returns, at http://shop.trihound.com/termsandconditions.sc.

    6. Reviews. If we make it possible to post product reviews, we hope all your reviews will be positive and straightforward, but our lawyers have advised us that we have to say the following:

    a. You are solely responsible for the contents of any review (“Review”) that you that you post to the Trihound Site and the consequences of posting or publishing that Review.   

    b. You affirm, represent, and/or warrant that you own or have the necessary licenses, rights, and permissions to (i) reproduce, display, distribute copies of, create derivative works (adaptation) of, or otherwise use all Reviews that you post, in the way that the Trihound Site contemplates, and (ii) to authorize us to do so. This means that with respect to any Review that you post, (i) you wrote the Review  yourself; (ii) if you did not create that Review yourself, or if the Review contains any content created or owned by anyone else, such as a quotation, you have written permission from that person or company to post that content on the Trihound Site; and (iii) if any Review includes any name of any person other than you, you have written permission to post, that name as part of that Review  on the Trihound Site. If any Review doesn’t meet these requirements, and we are sued by someone as a result of your posting it on the Trihound Site, you will have to pay our legal fees.

We have the right but not the obligation to review any Review and remove it or take other action if we determine that it fails to comply with these rules or that it contains content that is not appropriate for posting on the Trihound Site, such as, but not limited to, material that is patently offensive to the online community, such as content that promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual, material that harasses or advocates harassment of another person, or material that is false or misleading, or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory, or libelous.

    d. By posting a Review to the Trihound Site, you automatically grant, and you represent and warrant that you have the right to grant, to Trihound an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, display, and distribute that Review and all the information in it and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.

    7. DISCLAIMER OF WARRANTIES.  TRIHOUND EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, RELATING TO ANY PRODUCT OR YOUR USE OF THE TRIHOUND SITE, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE. Some jurisdictions do not allow the disclaimer of implied warranties, some of the foregoing disclaimers may not apply to you insofar as they relate to implied warranties.

    8. Limitation on liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY DAMAGES, UNDER ANY CAUSE OF ACTION, WILL NOT EXCEED IN THE AGGREGATE THE AMOUNT OF MONEY THAT YOU ACTUALLY PAID TO TRIHOUND DURING THE MONTH IMMEDIATELY PRECEDING THE ACT THAT YOU CLAIM GAVE RISE TO SUCH LIABILITY. 

    9. Governing Law, Jurisdiction, Time Limit on Claims. If you have any dispute with us, the dispute will be governed by the laws of the State of New York without regard to its conflict of law provisions. You hereby submit to personal jurisdiction by and venue in the state and federal courts of the State of New York, City of White Plains. Regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Trihound Site or the TOU must be filed within one (1) year after such claim or cause of action arose or be forever barred.

    10. Additional Terms.  Our failure to exercise or enforce any right or provision of the TOU will not constitute a waiver of such right or provision. If a court of competent jurisdiction holds any provision of the TOU invalid, the court should try to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOU will remain in full force and effect.

    • We will store your name, mailing address, and e-mail address internally and we may use that information to send you any news and promotional or product updates.

  • At this time, Trihound ships merchandise to locations within the United States and U.S. territories, including Alaska, Hawaii, Puerto Rico, Guam, and the US Virgin Islands. Additionally, Trihound ships merchandise to Canada and Mexico, but not to other international locations. The risk of loss and title for all merchandise ordered on this Web site pass to you when the merchandise is delivered to the shipping carrier.
